DeskSay is made by Lumiere Media, Inc. These are the terms you agree to when you download, trial or subscribe to it. They are written to be read, so they are in plain English rather than in capital letters.
When you subscribe to DeskSay you are buying a licence to use it, not the software itself. The licence is personal to you or to your company, it lasts as long as your subscription does, and it covers the number of Macs you chose at checkout, each one a Mac you own or primarily use. You can change that number at any time at desksay.com/manage.
The price is $1 per Mac per month, or $10 per Mac per year. Each subscription comes with one licence key. You activate that key on each Mac from inside the app, up to the number of Macs on the subscription, and deactivating a Mac frees its place for another one. If you reduce the number of Macs below the number already activated, nothing that is working stops, but no further Mac can be activated until one is deactivated.
You may use it for work, including at a company you are employed by.
Lifetime licences. A licence bought through AppSumo, or bought outright before DeskSay became a subscription, does not renew and does not end on its own. It covers the number of Macs stated when you bought it, activated the same way, and it includes every update we release, as section 7 says. AppSumo is the seller of its codes, so its refund policy applies to them rather than section 8, and there is no subscription to manage at desksay.com/manage.
Payment is taken by Stripe and the subscription renews, monthly or yearly, until you cancel. You can cancel at any time, from Settings, Licence, Manage subscription in the app or at desksay.com/manage. Both open Stripe's customer portal, where you can also change the number of Macs, update your card and see your invoices. Cancelling stops the next charge; the licence runs to the end of the period you have already paid for and then ends.
If a renewal payment fails, Stripe retries it for a while and the licence keeps working during that time. If the payment still does not go through, the subscription and the licence end.
A discount applied at checkout, such as a promotion code, stays on that subscription for as long as it lasts, unless the promotion's own terms say otherwise.
DeskSay runs free for 14 days with every feature enabled, no card and no account. The trial is tied to a one way hash of your Mac's hardware identifier, so reinstalling the app does not start it again. These terms apply to you during the trial too, in particular section 6.
Nothing is deleted. Your desktop names, notes and time records stay, and the app keeps working with limits rather than turning into a nag screen: switching is capped at 30 a month, and voice, drag to move, the notch strip and automations are off until you subscribe. Subscribing lifts all of that.
Once a key is activated, the app confirms it with our server about every 7 days. It does not need to be online to work: it keeps working for 30 days without reaching the server, then warns you, and after 60 days it falls back to the limits in section 4 until it can check again. If the server answers that the subscription has ended, the limits apply from that check.
DeskSay is protected by copyright whether or not you agree to these terms. This section adds obligations on top of that, it does not replace it.
Your subscription includes every update we release while it is active. From version 1.2.2 the app updates itself: it checks once a day, downloads a new version in the background and installs it when you next quit or when you accept the prompt. Both the automatic check and the automatic install can be switched off in Settings, General, and you can check by hand from the menu at any time.
We do not refund a period that has already started. The 14 day trial, with every feature and no card, is there so you can find out whether DeskSay works for you before you pay anything. If you no longer want it, cancel and the next charge does not happen.
If DeskSay stops working because of something we did, write to support at desksay.com and we will make it right. Nothing in this section removes a statutory right to cancel or to a refund that cannot be waived by agreement, and section 12 says the same about consumer rights generally. A refund or a payment dispute ends the licence it was paid for, as section 14 says.
DeskSay asks macOS for these permissions, and each can be refused. Naming desktops needs none of them; each one unlocks the feature beside it and nothing else.
The short version: your voice never leaves your Mac, there is no account, and the app itself has no analytics. Crash reports are off unless you turn them on. The website is separate and it does use analytics, Google's included. The full detail is in the privacy policy, which is part of these terms.
macOS provides no public interface for naming or switching desktops, so DeskSay uses private system interfaces, which is the only way this can be built. It is designed so that if Apple changes or removes one, the affected feature stops working rather than the app crashing.
We cannot promise that a future version of macOS will leave every feature working. If one breaks we will fix it if we can, and if a core feature cannot be restored we will deal with it individually rather than leaving you with something that does not work.
DeskSay is provided as it is. We do not warrant that it will be uninterrupted, error free, or fit for a particular purpose, and to the extent the law allows we exclude the implied warranties that would otherwise apply.
Nothing here removes rights you have as a consumer that cannot be removed by agreement.
To the extent the law allows, Lumiere Media, Inc. is not liable for indirect or consequential loss, for lost profits, or for lost data. Our total liability to you is limited to what you paid for DeskSay.
Your licence ends when your subscription ends, if you break section 6, and when a payment is refunded or disputed. A lifetime licence ends only in the last two cases. When it ends, the app drops to the limits in section 4 at its next licence check. You may stop using DeskSay at any time. Uninstalling it removes the app; your names and notes live in your own user folder and you can delete them yourself.
We may update these terms. The effective date at the top changes when we do, and the current version is always at desksay.com/terms. A change never applies retroactively to a period you have already paid for.
These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law rules, and the courts of Pennsylvania have jurisdiction over any dispute.
